These general terms and conditions are part of the contract for all services (= sale of goods and provision of services, etc.) of the company Redfield Records, owner Alexander Schröder, Sandweg 1, D- 49324 Melle, - hereinafter referred to as Redfield Records -, and the customer, -im named the following customer-.
I. General
1. The following general terms and conditions apply exclusively. Conditions that conflict with or deviate from these General Terms and Conditions will not be recognized unless Redfield Records has expressly agreed to their validity in writing.
2. All agreements made between the customer and Redfield Records for the purpose of executing this contract are set out in writing either in the order, the order form and these General Terms and Conditions.
II. Offer and conclusion of the contract
1. The offers on this website are non-binding and merely represent an invitation to submit an offer. The customer's order therefore merely represents an offer to conclude a purchase contract. A contract is only concluded through a written order confirmation (via email, etc .) from Redfield Records or through execution of the order.
2. By purchasing an admission ticket, contractual relationships come into being exclusively between the cardholder (customer) and the respective organizer. Redfield Records only arranges the event contract in the name and on behalf of the respective organizer and is commissioned by the customer to process the ticket purchase, including shipping. Tickets are only sold to end customers.
3. Every order for admission tickets is binding immediately after confirmation and requires acceptance and payment for the ordered tickets. The regulations on distance selling contracts do not apply in such a case (§ 312b III No. 6 BGB). In this respect, there is no right of withdrawal.
4. In principle, only normal household quantities are distributed. Larger deliveries only after prior special agreement.
III. Prices and payment terms
1. Our prices are in euros (EUR) including the applicable statutory value added tax (VAT). The prices valid on the day the order is accepted always apply to the calculation.
2. Deliveries of goods within Germany:
a. The payment is made in advance. (Bank transfer and PayPal)
b. Packaging and postage are calculated based on the actual costs incurred. These depend on the items ordered and the country of order.
3. Deliveries of goods abroad:
a. Purchases are made exclusively in advance. (Bank transfer and PayPal)
b. Packaging and postage are calculated based on the actual costs incurred. These depend on the items ordered and the country of order.
4. The customer is only entitled to offsetting rights if his counterclaims have been legally established, are undisputed or recognized by Redfield Records. In addition, the customer is only authorized to exercise a right of retention to the extent that his counterclaim is based on the same contractual relationship.
IV. Delivery conditions
1. Order options:

2. Shipping:
Orders are usually processed on the same day. If the customer has ordered online, they will receive a confirmation email. If the goods are in stock, delivery usually takes place within two days, but usually on the day of receipt of payment (if paid in advance).
Packaging and postage are calculated based on the actual costs incurred. These depend on the items ordered and the country of order.
When ordering, the current prices listed on the Redfield Records homepage apply. All offers only while stocks last, printing errors excepted. If the customer expects a package from Redfield Records, he must also ensure that it is accepted. Otherwise, Redfield Records must charge the customer for the postage for re-sending.
If problems arise, the customer can contact Redfield Records for clarification.
Important:
Shipments returned freight forwarded to Redfield Records will not be accepted. The exchange of ordered goods is only possible in the event of manufacturing defects.
3. Redfield Records is entitled to withdraw from the contract if self-delivery is not made. This does not apply if Redfield Records is responsible for the failure to supply itself.
4. In the event of delivery delays due to force majeure, operational disruptions, strikes, delivery bans or other circumstances for which Redfield Records is not responsible, the delivery period will be extended to an appropriate extent.
5. Compliance with the delivery obligations also requires the timely and proper fulfillment of the customer's obligation. The exception of the unfulfilled contract remains reserved.
6. If the customer defaults on acceptance or violates other obligations to cooperate, Redfield Records is entitled to demand compensation for the resulting damage, including additional expenses. Redfield Records reserves the right to make any further claims.
7. If the requirements of the previous paragraph (delay in acceptance) are met, the risk of accidental loss or accidental deterioration of the purchased item passes to the customer at the point in time at which he or she is in default of acceptance or debtor.
8. As long as the customer is in arrears with a liability, Redfield Records' delivery obligation is suspended.
9. Redfield Records is entitled to make partial deliveries as long as this is reasonable for the customer.
V. Liability
Redfield Records is only liable to the customer in the event of intentional or grossly negligent behavior, unless it concerns damages resulting from injury to body, life or health, which is based on a breach of duty by Redfield Records or one of its legal representatives or vicarious agents or if the customer asserts claims under the Product Liability Act.
VI. Warranty for defects and liability for fan items
1. The statutory warranty period is 2 years from delivery of the goods.
2. If the remedy of the defect fails, or if Redfield Records is not willing or unable to remedy the defect or deliver a replacement, or if this is delayed beyond a reasonable period of time for reasons for which Redfield Records is responsible, the customer is entitled to withdraw from the contract to withdraw or to demand a reduction in the purchase price.
3. The customer is only entitled to withdraw from the contract if Redfield Records has not met a reasonable grace period set in writing by the customer. The withdrawal must be communicated in writing by the customer.
VII. Right of withdrawal
1. The customer can revoke his contractual declaration within two weeks of receiving the goods without giving reasons in text form (e.g. letter, fax, email) or by returning the goods. The period begins at the earliest upon receipt of information about the existing right of withdrawal. To meet the cancellation deadline, it is sufficient to send the cancellation or the item in a timely manner. The revocation can be made by email to info (at) redfield-records.de or in writing to Redfield Records, Sandweg 1, D-49324 Melle.
2. If the cancellation is made on time, the services received by both parties must be returned. If the customer cannot return the goods or services in whole or in part or only in a deteriorated condition, he must pay Redfield Records appropriate compensation.
3. For an order up to EUR 40, the customer may be obliged to cover the regular costs of returning the goods, unless the goods delivered do not correspond to those ordered.
4. The right of withdrawal also does not apply to the delivery of audio or video recordings or software, provided that the data carriers delivered have been unsealed by the customer.
5. When selling admission tickets, the regulations on distance selling contracts in accordance with Section 312b III No. 6 BGB do not apply, with the result that there is no right of withdrawal in these cases.
VIII. Exchanges and complaints about fan articles
1. The care instructions for the textiles must be strictly followed. The consumer must pay Redfield Records appropriate compensation for the deterioration caused by the intended use of the item. This also applies if the consumer has handled the goods carefully. If the 14-day right of withdrawal is exercised, the customer can avoid the obligation to pay compensation by not using the goods within this period.
2. CD covers, CD inner sleeves, CD wreaths and video sleeves are part of the packaging and are therefore not covered by the right of withdrawal.
3. Redfield Records strives to always provide the most current version (e.g. current tour dates, improved designs, etc.). There may therefore be deviations in the back and sleeve prints of the T-shirts etc. Due to the complex production process, all-over prints may have unprinted areas at the edges, which cannot be avoided and do not constitute a defect.
4. If the goods are not delivered until 4 months after the conclusion of the contract for reasons for which the customer is responsible, Redfield Records reserves the right to change prices.
IX. Retention of title
1. The fan articles and sound recordings remain the property of Redfield Records until all payments resulting from the delivery contract have been received.
2. If the customer behaves in violation of the contract, in particular in default of payment, Redfield Records is entitled to take back the purchased item. The withdrawal and seizure of the reserved item by Redfield Records does not constitute a withdrawal from the contract.
3. The customer undertakes to treat the goods with care until full payment has been made.
X. Data protection
1. Redfield Records guarantees compliance with data protection regulations and only uses the transmitted data for order processing purposes. Use of this website constitutes the customer's consent to the collection of such data by Redfield Records.
2. No security guarantee can be given for data transmitted via a normal server.
3. All systems in which customer data is stored are password protected and only accessible to a specific group of people. This is prohibited from being passed on to third parties due to strict security requirements.
4. It is guaranteed that this data will not be sold or partially rented to third parties for advertising or other purposes. However, analysis and improvement of the customer database by trustworthy third parties cannot be ruled out.
5. The customer can object to the described use of his data at any time. The objection can be made by email info (at) redfield-records.de or in writing to Redfield Records, c/o Redfield Records, Sandweg 1, D-49324 Melle.
XI. Applicable Law
1. The invalidity of individual provisions of the purchase contract does not result in the invalidity of the entire purchase contract. In such a case, the parties agree to replace the invalid provision with a valid provision that comes closest to what is economically intended.
2. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
3. Unless otherwise stated in the contract confirmation, our place of business is the place of performance.
